ESMA Tightens MiCA Requirements for Stablecoin Services in the EU
ESMA has issued a new supervisory opinion clarifying how MiCA-authorised CASPs must handle stablecoins that do not comply with EU regulatory requirements.

Under ESMA's expectations, CASPs should stop offering EU clients services involving non-compliant asset-referenced tokens (ARTs) and e-money tokens (EMTs).

🔎 What does this mean for businesses?

The requirements affect a wide range of activities, including:
✓ Exchange and trading services
✓ Custody and wallet services
✓ Transfers and transaction execution
✓ Investment and portfolio management

⏳ Three-Month Remediation Period
Where existing non-compliant exposures remain, national regulators should require remediation as soon as possible and no later than three months after the opinion's publication.

During this period, any continued services should be limited to necessary activities such as conversion, withdrawal, transfer or safekeeping, under regulatory supervision.

⚖️ Why Is This Important?
MiCA compliance goes beyond obtaining authorisation. CASPs must continuously review supported assets, internal procedures and operational controls to meet evolving regulatory expectations.
