As of December 30, 2024, the MiCA has officially entered into force across the European Union — marking the first comprehensive regulatory framework for virtual assets in the EU. However, Poland has not yet finalized local rules, creating temporary uncertainty for businesses in this field.

🕒 What’s the Current Situation?

Entities that are already listed in the Polish VASP register are allowed to continue their operations, subject to the following transitional deadlines:

• Until June 1, 2025, if a complete CASP license application has not been submitted by May 1, 2025;
• Until the application is processed, but no later than September 30, 2025, provided that the CASP license application is submitted on time.

These provisions are based on Poland’s draft Virtual Assets Market Act. However, due to delays in its adoption by January 2025, the authorities announced a departure from strict deadlines marking the end of the transitional period.

Our team applied to the Department of Finance and Innovation of the Komisja Nadzoru Finansowego and received an official response that there is no procedure for submitting documents for licensing.
